This page explains British Swimming’s judicial system and how the Judicial Code document is used to govern the procedures of any protests or complaints.

British Swimming’s Judicial system is in place to deal fairly with protests and complaints in relation to matters falling under British Swimming's jurisdiction, as detailed at Rule 3 of the Code.

This includes those arising from competitions promoted by or on behalf of British Swimming in England, Scotland or Wales.

British Swimming’s Judicial Code sets out procedures relating how to bring a complaint, and how it will then be processed through the judicial system.

An electronic copy of the current British Swimming Judicial Code is available here. This version is an update of the February 2009 copy. Although no changes have been made to any of the Rules, it does incorporate any changes made since its first publication in 2009 (which are also referenced below for convenience).

Past Versions of the Judicial Code

A copy of the February 2009-version of the Judicial Code is available here. However, please note that this is for historical use only and that following its print, the following changes were made to its text. These changes have now been incorporated into the current version of the Code (November 2010 ed.)

Any reference in the Judicial Code (February 2009) to the address of the Judicial Administrator of British Swimming should now read:

Judicial Administrator, British Swimming, SportPark, 3 Oakwood Drive, Loughborough, Leicestershire, LE11 3QF.

 

On 24th January 2010, the British Swimming Board approved with immediate effect changes to Rules 13.6 and 15.6 of the British Swimming Judicial Code (February 2009).

These Rules shall now read as follows:

Rule 13.6 No member of the Managing Board or Technical Committees of British Swimming or Managing Boards, Committees (other than those with purely advisory functions) or Technical Committees of the ASA, SASA or the WASA shall be appointed as a member of the Judicial Panel.

Rule 15.6 No member of the Managing Board or Technical Committees of British Swimming or Managing Boards, Committees (other than those with purely advisory functions) or Technical Committees of the ASA, SASA or the WASA shall be appointed as a member of the Appeal Panel.

 

Please be advised that in the British Swimming Judicial Code (February 2009) at rule 20.1 there is a misprint.

Rule 20.1 should read as follows:

“20.1 A complaint shall be made by sending to the Judicial Administrator a completed applicable form of complaint (save as provided by rule 12.3.1.2 above). The form (and any communication directed to be sent to the Judicial Administrator under these Rules) shall be sent to the Judicial Administrator, Harold Fern House, Derby Square, Loughborough, Leicestershire LE11 5AL. The complaint must be accompanied by the requisite fee.”
